PUBLIC OFFER AGREEMENT

This Public Offer Agreement (“Offer”) is made by SCALERS LLC, a company registered in the Republic of Uzbekistan, operating the website https://uzsong.com (hereinafter referred to as the “Company”).

By placing an order on the Website, the Customer fully accepts the terms of this Offer.

1. GENERAL PROVISIONS

1.1. This document constitutes a public offer in accordance with the legislation of the Republic of Uzbekistan.

1.2. Acceptance of this Offer occurs when the Customer submits an order and/or completes payment on the Website.

1.3. From the moment of acceptance, a legally binding agreement is concluded between the Company and the Customer.

2. SERVICES

2.1. The Company provides personalized digital music creation services.

2.2. The final product may include:

  • Personalized song;
  • Song lyrics;
  • Music video (if ordered);
  • Additional digital products available on the Website.

2.3. All products are delivered electronically.

3. ORDER PROCESS

3.1. The Customer provides information necessary for creating the personalized song.

3.2. The Customer is solely responsible for the accuracy of the submitted information.

3.3. The Company may refuse orders containing illegal, offensive, discriminatory, defamatory or otherwise prohibited content.

4. PAYMENT

4.1. Prices are displayed on the Website.

4.2. Payment is made through available payment methods displayed during checkout.

4.3. The order enters production after successful payment.

5. DELIVERY

5.1. Delivery is made electronically to the email address provided by the Customer.

5.2. Estimated delivery times are displayed during checkout.

5.3. Delivery times are estimates and may vary due to technical or operational circumstances.

6. REVISIONS

6.1. Free revisions are provided only in cases of:

  • factual errors;
  • incorrect names;
  • technical defects.

6.2. Requests involving style changes, genre changes, additional information, or changes of creative direction may require a new order or additional payment.

7. REFUNDS

7.1. Due to the personalized nature of the digital products, payments are generally non-refundable once production has started.

7.2. Refunds may be considered if:

  • the Company fails to deliver the product;
  • delivery becomes impossible due to the Company’s fault.

7.3. Refund requests must be submitted within seven (7) days from the scheduled delivery date.

8. INTELLECTUAL PROPERTY

8.1. The Company retains ownership of all intellectual property rights related to the Website, software, and production process.

8.2. Upon delivery, the Customer receives a non-exclusive personal license to use the purchased content.

8.3. The Customer may not resell the content without prior written permission.

9. LIMITATION OF LIABILITY

9.1. The Company shall not be liable for indirect, incidental, consequential or special damages.

9.2. The Company’s maximum liability shall not exceed the amount paid by the Customer for the relevant order.

10. PERSONAL DATA

10.1. Personal data is processed in accordance with the Privacy Policy available on the Website.

10.2. By placing an order, the Customer agrees to such processing.

11. GOVERNING LAW

11.1. This Offer shall be governed by the laws of the Republic of Uzbekistan.

11.2. Any disputes shall first be resolved through negotiations.

11.3. If negotiations fail, disputes shall be resolved in accordance with the legislation of the Republic of Uzbekistan.
